Xavier Moot Court Competition (XMCC) 2026 on Foreign Investment Law at Xavier Law School, St. Xavier's University, Kolkata [Offline; 29-31 October; Cash Prizes Rs 1.5 Lakh; Register by 20 October]

The Moot Court Society (MCS) of Xavier Law School, St. Xavier's University, Kolkata (SXUK) presents the Xavier Moot Court Competition 2026 (XMCC'26), a national moot court competition on Foreign Investment Law. It is held at the SXUK campus in New Town, Kolkata from 29 to 31 October 2026, with Khaitan & Co, MCO Legals and Sinha & Co listed as partners on the official brochure.

The moot problem is an investor-state dispute under a bilateral investment treaty between two fictional States (Valoria and Oakhaven), with ICSID as one of the agreed forums. Teams argue for the Claimant investor and for the Respondent State, dealing with questions such as the umbrella clause, most-favoured-nation treatment and fair and equitable treatment. The moot problem, the treaty exhibits and annexures, and the brochure are all in the official XMCC'26 documents folder.

St. Xavier's University, Kolkata is a Jesuit-run private university established on 8 February 2017, with a 16.64-acre campus in New Town, Kolkata. Xavier Law School was set up in August 2019 and offers the B.A. LL.B. (Hons.), B.Com. LL.B. (Hons.), an LL.M. and a Ph.D. in Law. Its student-run Moot Court Society has earlier hosted the intra-XLS moot XavJudice, the national moot XavAequitas (2024) and the Surana & Surana and St. Xavier's University Technology Law Moot Court Competition (2026). Dr. Animesh Das is the faculty Convener and Dr. Asif Iqubal Shah the Co-Convener of the MCS.

• Open to students of three-year LL.B. and five-year integrated LL.B. programmes at any law school, college, university or institution recognised by the Bar Council of India. LL.M. students are also eligible.
• Students from any year or semester may participate, and cross-year teams are allowed, provided all members belong to the same institution.
• Each team nominates Speakers and one Researcher; roles are declared at registration and are not ordinarily changed after confirmation.
• A maximum of two teams per institution.
• Registrations are accepted on a first-come, first-served basis, and the Organising Committee may close the form once maximum intake is reached.

• Two Preliminary Rounds: every team argues once for the Claimant and once for the Respondent State, with sides and opponents decided by draw of lots. The top eight teams on cumulative preliminary scores go to the Quarter-Finals.
• Quarter-Finals, Semi-Finals and the Final are knockout rounds, with preliminary scores not carried forward.
• Oral time per side: 20 minutes in the Preliminaries (12 minutes per speaker at most), 25 minutes in the Quarter-Finals, 30 minutes in the Semi-Finals and 40 minutes in the Final, plus a combined rebuttal and sur-rebuttal allowance of 5 to 6 minutes.
• An Ex-Parte Round is held if an odd number of teams leaves one team unpaired, with the Judges acting as the opposing side.
• Each team's Researcher must sit the Researcher's Test, an MCQ test held on 29 October 2026. A team whose Researcher misses it is not eligible for the Best Researcher award.

• Every team submits memorials for both sides, the Claimant and the Respondent State, as soft copies in DOCX and PDF with the subject line "Memorials (Team Code) - XMCC'26", followed by hard copies.
• Cover pages: blue for the Claimant and red for the Respondent State, carrying the team code, the court, the parties, the nature of the case and the title of the document. No individual names anywhere.
• Times New Roman 12 with 1.5 spacing and 1-inch margins; footnotes in Times New Roman 10, single spaced; OSCOLA (5th edition) citation.
• Total page limit of 42 pages, including Statement of Facts (up to 3 pages), Summary of Arguments (up to 2 pages) and Arguments Advanced (up to 25 pages). A separate compendium of authorities is allowed.
• Plagiarism must stay within 10%; 1 mark is deducted for every 2% beyond the limit, and a breach of anonymity leads to disqualification.

• Team registration fee: Rs 4,500 per team, inclusive of all taxes, paid by bank transfer to the account given in the official brochure (beneficiary: St. Xavier's University Kolkata Alumni Association, Canara Bank).
• After paying, submit the official XMCC'26 Team Registration Form (Google sign-in required) with each participant's details and college ID card, a Bona Fide Certificate from your institution in PDF naming the team members and their roles, and the payment receipt in PDF.
• Registration is confirmed only after the Organising Committee verifies the documents and payment and sends a confirmation email.
• Last date to register (team and hostel): 20 October 2026.

• Optional non-AC shared hostel rooms on the SXUK campus for 29, 30 and 31 October 2026, with separate facilities for male and female participants and breakfast, lunch and dinner included. Check-in from 7:00 AM on 29 October; check-out by 10:00 AM on 1 November.
• Charges: Rs 700 (individual), Rs 1,400 (dual) or Rs 2,100 (team) per day, inclusive of taxes and non-refundable once paid. Allotment is first-come, first-served, subject to availability.
• Pay the hostel fee and then submit the separate Hostel Accommodation Registration Form. Travel costs are borne by participants.

Besides the cash prizes, the brochure lists internship opportunities at Khaitan & Co, MCO Legals and Sinha & Co.

Participants must wear law formals (black blazer, white shirt, trousers, black tie and shoes), carry their college ID card and the XMCC'26 ID card, and must not reveal their institution's identity in any way. Mobile phones and smart watches are prohibited during oral rounds, and alcohol, drugs and smoking are banned on the University premises.
